Terms and Conditions

These Terms and Conditions govern purchases from The Brain Art. The seller is Hannes de Bruyn trading as The Brain Art. By placing an order, you agree to these terms, our Privacy Policy, Digital Products Refund Policy and Digital Download & Licence Policy.

2. Digital products

Products are supplied electronically. Product images showing physical books, frames or other objects are visual mockups unless a product page expressly states that a physical item is included. No shipping is required for digital products.

3. Prices and payment

Prices are shown in South African rand (ZAR). Payment is processed securely through Yoco using the payment methods displayed at checkout. International customers may be charged currency-conversion or bank fees by their card issuer. An order is accepted once payment is authorised and an order confirmation is issued.

4. Delivery and access

After successful payment, download access is normally supplied on the confirmation page, through your account where applicable, and by email. You are responsible for supplying a correct email address, keeping account credentials secure and downloading files within any stated download or expiry limits. Contact us if access does not arrive or a file cannot be opened.

5. Licence and intellectual property

Unless a product page expressly grants a different licence, your purchase gives you a limited, non-exclusive, non-transferable licence for personal use only. Copyright and all other intellectual-property rights remain with The Brain Art or the identified creator. You may not resell, redistribute, share, upload, sublicense, copy for others, remove rights notices, or use a product commercially unless the product page or a written agreement expressly permits it.

6. Product descriptions

We aim to describe each product accurately. Screen colours, device rendering and print results may vary. You should review the stated file type, dimensions, page count, licence and compatibility before purchasing.

7. Refunds

Because digital products can be accessed or copied immediately, change-of-mind refunds are generally unavailable after download or access has been supplied. This does not limit rights that cannot lawfully be excluded. Our Digital Products Refund Policy explains the circumstances in which we will repair, replace or refund an order.

8. Acceptable use

You may not misuse the site, attempt unauthorised access, interfere with checkout or downloads, introduce malicious code, scrape protected content, or use our products unlawfully.

9. Availability

We may correct errors, update products, withdraw products or temporarily suspend site access. If we cannot fulfil a paid order, we will provide an appropriate remedy.

10. Liability

Nothing in these terms excludes or limits rights or liability that cannot be excluded under applicable law. To the extent permitted by law, we are not liable for indirect or consequential loss, loss caused by incompatible software or devices, unauthorised sharing, or circumstances outside our reasonable control. Our total liability relating to a product will not exceed the amount paid for that product, except where the law requires otherwise.

11. Governing law

These terms are governed by the laws of the Republic of South Africa. Consumers retain any mandatory protections that apply in their country of residence.
